Abstract

Dalam rangka memberi jaminan kepastian hukum terkait kepemilikan dan penguasaan tanah, maka pemerintah mengadakan pendaftaran tanah di seluruh Indonesia. Berdasarkan data yang dikutip dari Dokumen DAK Integrasi Tahun 2022 menyatakan bahwa Kampung Pasole Banar memiliki permasalahan pertanahan, yakni minimnya kepemilikan sertifikat hak atas tanah. Penelitian ini membahas terkait strategi peningkatan legalitas tanah pada Kampung Pasole Banar Kelurahan Sidodamai. Rumusan masalah dalam penelitian ini adalah apa faktor penghambat dalam peningkatan legalitas tanah tanah di RT. 17 Kampung Pasole Banar Kelurahan Sidodamai dari persepsi masyarakat. Jenis penelitian yang digunakan dalam penelitian ini adalah penelitian campuran (mixed methods) dengan metode analisis data meliputi metode analisis deskriptif, analisis faktor, serta analisis SWOT. Hasil dari penelitian menunjukkan bahwa tingkat legalitas di RT. 17 Kampung Pasole Banar Kelurahan Sidodamai didominasi oleh legalitas informal sebanyak 71% atau 56 unit tanah. Faktor penghambat dalam peningkatan legalitas tanah pada RT. 17 Kampung Pasole Banar Kelurahan Sidodamai antara lain faktor penghambat dari masyarakat serta faktor penghambat dari pemerintah. Sedangkan strategi untuk meningkatkan legalitas tanah didapatkan sebanyak 12 strategi, namun untuk strategi prioritasnya adalah melaksanakan forum komunikasi atau sosialisasi antara pemerintah dengan masyarakat terkait pentingnya pendaftaran tanah beserta pelaksanaanya, memaksimalkan kemajuan teknologi dan informasi sehingga seluruh masyarakat dapat mengakses informasi dengan mudahnya terkait pendaftaran tanah dengan tampilan yang mudah dimengerti oleh masyarakat, serta membangun sistem administrasi pendaftaran tanah yang efisien, akuntabel, dan transparan berbasis teknologi dan informasi untuk menjaga kepercayaan masyarakat.
